Dustin Parris is a former student at North Shelby School. Dustin is severely autistic and cannot speak. On May 23, 2019 Dustin was severely injured at North Shelby School. From an assault from a teacher at North Shelby School. Dustin’s Mother, Suzan Parris has been trying to find out what happened and hopefully make CCS safe for students in the future. The latest effort being a Closed Session at the February 8, 2021 School Board Meeting. Where, unfortunately, the NEW School Board majority took NO ACTION!! And the new Attorney obviously advised the NEW School Board majority to not speak to anyone about this issue as a lawsuit may ultimately be filed against CCS.
The purpose of this article is to define some legal terms and legal concepts so readers can better understand the issues that will be discussed as we work our way through the complexity of the issues involved here.
Please note that NO Child was actually murdered in this incident. But that was only because of luck and nothing else but luck. Dustin Parris escaped death by only fractions of an inch as the back of his head struck an exposed drain pipe in his fall to the ground backwards from the teachers malicious and wanton attack. It should also be made known that this so-called drain pipe is not properly installed, is not for outside service and does not drain anything. It is only a safety hazard that still exists as only a safety hazard.
NC General Statute 14-17
(b) A murder other than described in subsection (a) or (a1) of this section or in G.S. 14-23.2 (-Killing of an unborn child-That is for another discussion for another day) shall be deemed second degree murder. Any person who commits second degree murder shall be punished as a Class B1 felon, except that a person who commits second degree murder shall be punished as a Class B2 felon in either of the following circumstances:
(1) The malice necessary to prove second degree murder is based on an inherently dangerous act or omission, done in such a reckless and wanton manner as to manifest a mind utterly without regard for human life and social duty and deliberately bent on mischief.
Malice definition, desire to inflict injury, harm, or suffering on another, either because of a hostile impulse or out of deep-seated meanness…
Reckless definition, without thinking or caring about the consequences of an action.
Wanton definition, of a cruel or violent action- deliberate and unprovoked.
Remember these words and what they mean. You will be hearing more about them later in other contexts.
Also, in regard to the exposed drain pipe that put a 6 in slash in the back of Dustin Parris’ head. The drain pipe sticks out above ground a couple of inches so it performs no drain function. There is now a thin rubber cover installed that also prevents any drainage and was only applied after Dustin Parris hit his head on it. A feeble “band-aide” to hide that it serves no useful purpose, is a known safety hazard and should be removed and whatever pipe is attached to it should be cut off and capped below ground. Just more incompetence from CCS in regard to the construction of the New North Shelby School Project. And $Million$ in construction cost overruns.
I will say right now, again, that my review of the documents that I have causes me to believe that NO child is safe at Cleveland County Schools. There are safety hazards and bad teachers like the one that assaulted Dustin Parris. I have received additional information that this same teacher has assaulted autistic children before she assaulted Dustin Parris, and after. And she is apparently still on the job assaulting children as there is no accountability at CCS. Only cover-up and lies. And a new set of lawyers that are just like the old set of lawyers. Their job is to cover-up bad acts from CCS, School Board and Staff. NOT to see to it that CCS is doing what is in the best interest of the children. I reckon I am about the only one that is doing that. Certainly NOT the NEW School Board Majority.
