Prominent Shelby Attorney Oliver Max Gardner III is presently in a Gastonia Hospital suffering from serious injuries inflicted upon him by his grown stepson, allegedly aided and goaded on by his pistol packing Mama.<\/p>\n

According to reports, Mr. Gardner was at his home in Upper Cleveland County when he was accosted by his estranged second wife and her grown son by a previous marriage. Allegedly Mrs. Gardner pulled a pistol on Mr. Gardner and when he turned to walk away, the stepson tackled Mr. Gardner from behind with extreme and excessive force such that Mr. Gardner was knocked unconscious. Then beaten some more. All this resulted in various scrapes and bruises and other minor injuries. But also resulted in a head and brain injury that caused blood clots which then resulted in a stroke that has left Mr. Gardner paralyzed on one side and presently unable to walk.<\/p>\n

More disturbing news of this particular event began a few days and weeks before.<\/p>\n

Mrs. Gardner allegedly presented Mr. Gardner with a proposed offer to divide all marital property by giving Mr. Gardner all marital property for all his remaining life; with the provision that all such property would then revert to Mrs. Gardner and her heirs upon Mr. Gardner\u2019s death.<\/p>\n

Then, days later, Mrs. Gardner allegedly approached Mr. Gardner saying \u201cI am going to kill you,\u201d pulled that very same pistol and firing that pistol at Mr. Gardner\u2019s head, but missing. Mr. Gardner escaped and filed the appropriate criminal charges against Mrs. Gardner.<\/p>\n

A few days later two Cleveland County Sheriff\u2019s Deputies came out to arrest Mrs. Gardner on the above noted serious criminal charges. Then, during some discussion with Mrs. Gardner, Mrs. Gardner tells the officers that she has \u201cPlastic Surgery\u201d scheduled for Monday Morning. The officers somehow decide NOT to arrest Mrs. Gardner and leave the premises. Also leaving Mrs. Gardner with her pistol.<\/p>\n

The next event is soon after, when an armed Mrs. Gardner, along with her grown son, allegedly attack Mr. Gardner causing serious injuries as previously described. And, leaving Mrs. Gardner in total physical possession of all of Mr. and Mrs. Gardner\u2019s Marital property. Land, Deeds, Checkbooks, Cash, Stocks, bonds vehicles, farm animals, equipment and such are also likely to be in Mrs. Gardner\u2019s possession and total control.<\/p>\n

What happens next between Mr. and Mrs. Gardner will probably be determined by Mr. Gardner\u2019s hopeful recovery and the proper administration of justice in this matter. There is however one item of high public interest. That being the Sheriff\u2019s Department personnel, armed with arrest warrants regarding serious and dangerous offenses, not arresting Mrs. Gardner when they had the opportunity.<\/p>\n

However, You can bet the farm that if the roles were reversed, if Mr. Gardner had been armed with a firearm, threatened to kill, and took a shot at Mrs. Gardner and Sheriff\u2019s Deputies failure to arrest Mr. Gardner which resulted in serious injury or death to Mrs. Gardner: it would be Hell to pay. ALL the National News would be in Cleveland County howling for the dismissal of Sheriff Alan Norman, The Judges, the School Board, The Commissioners, Tim Moore and everybody else Republican in North Carolina Government. That is Robert A\u2019s<\/b><\/u><\/strong>\u00a0speculation. It is also Robert A\u2019s<\/b><\/u><\/strong>\u00a0speculation that the recent Gardner Webb University Board of Trustee scandal involving the BoT apparent bogus removal of Mr. Max Gardner from the GWU BoTs was in some way, directly or indirectly, involved with emboldening Mrs. Gardner\u2019s actions against Mr. Max Gardner III. Time will tell.<\/p>\n
