\u00a0<\/strong>Mr. Willie Green promptly responded to my Part I Article that is included at the end of this article for your reminder and reading convenience.<\/p>\n

Articles that are continued over time are often hard to follow. Mr. Green\u2019s additional information was promptly presented. In stark contrast to the legal shenanigans of the Shelby city Officials ad their pawn, Stacy Heavner, who are all trying to drag out the situation-hoping that people of Shelby and Cleveland County are too stupid to catch-on much less keep up with the story. All the time spending close to $100 Thousand (to date) of taxpayer dollars on legal bills and refusing to talk about it.<\/p>\n

 <\/p>\n

Or talk about anything. Remember that article the Star put out where a number of Shelby City officials, The Mayor, Violet Dukes, and others spoke out after their lawyers told them to shut up. Only to get more lawsuits against them.<\/p>\n

 <\/p>\n

Anyway, the lawsuit against Stacy Heavner, the Crosstown blabbermouth who came out against Mr. Green\u2019s rezoning request, even though he was no expert on anything and didn\u2019t live in the neighborhood, found himself in a lawsuit and immediately stuck his head in the sand. Heavner refused to follow the Rules of Civil Procedure that are actually State Law. By law Heavner and anybody else who is sued has to file an \u201cAnswer\u201d to the Complaint made against him. Basically, admit to what is true, like admit he is a resident of Shelby North Carolina and such. He also has to deny the allegations against him that say he did something wrong. These rules\/laws were not just made for Stacy Heavner, but for everybody. Therefore, Stacy Heavner has a \u201cMotion to Compel\u201d filed against him where he has to show up for Court and tell the Judge why he should not be found in Contempt and possibly be jailed, if the Judge sees fit. That was the subject of my Part I article that is shown below for reader convenience.<\/p>\n

 <\/p>\n

But, like the rules that apply to YOU, ME and everybody else; Shelby Mayor Stan Anthony, Shelby City Manager Rick Howell and their \u201cstooge\u201d Stacy Heavner think they don\u2019t have to pay any attention to those rules and laws. And why should they when they have all the taxpayers in Shelby paying big money to high-dollar lawyers to use every legal, and maybe many illegal, tricks in the books to hide the truth of the matter. If not forever, long enough to run people like you and me and even Mr. Willie Green broke from our own lawyer bills paid out of our own pockets.<\/p>\n

 <\/p>\n

Another big-big reason for shutting down Mr. Green without providing an Answer to his lawsuit complaint or \u201cDiscovery\u201d of documents and record is the Answer and Discovery information are required to be sworn to under oath<\/u>. If anybody makes a false statement under oath, like \u201cI did not break any laws or do anything unethical,\u201d when it can be proved that they did, they have just proved themselves guilty of perjury. Perjury being a felony crime. And, if<\/u> the Mayor, City Manager and others on the City Council worked together to break any law in their efforts to \u201cHoo-Doo\u201d Mr. Green, they have committed a felony Conspiracy crime. Perjury and Conspiracy, both felony crimes that carry major fines and jail time, seem to go together here in the case of the City of Shelby and Stacy Heavner\u2019s wrongful acts against Mr. Green. Screw over Mr. Green and everybody lie about it seems to be the MO here.<\/p>\n

 <\/p>\n

Everybody that has paid any attention to what has happened to Mr. Green\u2019s attempts to provide collage scholarships for graduating high school students, build a Sports Complex to take kids off the streets and away from a life of crime as well as build some much needed housing in Shelby should conclude that a lot of lying and conspiring down at Shelby\u2019s City Hall has been going on. And a jury pool to try the crooks that are screwing Mr. Green, as well as everybody else, would come from Shelby and Cleveland County residents. Guilty, Guilty, Guilty should be the jury verdicts. And the city-hall crooks know that, IF the actual truth ever comes out in Court. So, the crooks are scared, worried and desperate.<\/p>\n

 <\/p>\n

That is where we are with the Stacy Heavner case that was the subject the Part I article that is included below. Here comes Part II. Which deals with the status of the lawsuit against Shelby Mayor Stan Anthony. Also, Mr. Green\u2019s lawsuit against City Manager Rick Howell is presently in the North Carolina Court of Appeals. Superior Court Judge W. Todd Pomeroy ruled back a few months ago that Rick Howell had taken actions against Mr. Green that were malicious and with criminal intent on Howell\u2019s part, which invalidated Howell\u2019s claim of immunity from prosecution. Howell has also refused to provide his Answer and Discovery to Mr. Green. We will probably make a separate article about Howell\u2019s Appeals Court Ruling when it finally hits the street.<\/p>\n

 <\/p>\n

Also remember that exactly ZERO of Mr. Willie Green\u2019s efforts to combat discrimination and injustice have been openly and publicly supported by the Black Community and their unelected leadership. Maybe some Zoom calls. Maybe some small talk chit-chat amongst themselves that they never admit to. Never a letter to the Editor. Never nothing. Except to call for the Confederate Soldier\u2019s Memorial Monument on the Shelby Court Square be removed. Even though that Confederate Memorial has NEVER committed one act of injustice to anybody for the past 100+ years since being erected. At a cost of ZERO for the Taxpayers as the United Daughters of the Confederacy paid for the memorial 100%. And, those who want to remove and relocate it have not offered one red cent toward the costs of removal and relocation of the statue.<\/p>\n

 <\/p>\n

Also, removing the Confederate Monument will provide ZERO jobs and ZERO economic development. Black or White! So, any return on investment is ZERO. No equality. No Equity. No Nothing. Spending even one dollar for no gain is totally waste. And, just think of all the descendants of those Confederate Soldiers, including myself, that you are going to piss off in the process! And I\u2019ve been trying to help resolve injustices in Cleveland County where I find them. Just how smart is that? For me and for you?<\/p>\n

Mr. Green\u2019s reply to me regarding the Part I article goes like this:<\/strong><\/p>\n

Stan Anthony\u2019s Discovery questions are due today, after he asked for a 30-day extension, in June. I have asked my attorney to file a motion to compel <\/u>with the courts to require him to respond to my discovery questions that he was given on May 14, 2020.<\/em><\/strong><\/p>\n

So, now a Hearing in Superior Court must be scheduled so a Judge can render a Court Order to require Mayor Stan Anthony to do what he (and his lawyer) already knows he is required to do. But Anthony\u2019s attorney has tons of taxpayer dollars behind her with ZERO oversight.<\/p>\n

But, You can bet,\u00a0 based on all the discussion and arguendo above, Anthony\u2019s attorney has a \u201clicense to steal\u201d all the taxpayer\u2019s dollars it takes to run down every loophole and every gimmick that there is-and even more that can be thought up-to defend Mayor Anthony. Even though Anthony was sued in his individual capacity.<\/p>\n

Stacy T, Heavner was the head speaker in opposition to Mr. Willie Green\u2019s request to revise the zoning on a portion of his property on East Dixon Boulevard. Heavner told the Shelby City Council that Mr. Green intended to build low-income housing on the property and a number of other things that were false. The City Council was apparently searching for any means possible, unethical, illegal or otherwise to deny Mr. Green\u2019s zoning change request and, using Heavner\u2019s lies as a reason did just that. Denied Mr. Green\u2019s request without even allowing Mr. Green the opportunity to speak for himself.<\/p>\n

 <\/p>\n

Also note that Mr. Green has alleged this wrongful action by the Shelby City Council an \u201corganized campaign\u201d against him that might spin off a series of other lawsuits.<\/p>\n

 <\/p>\n

First, Mr. Green filed a lawsuit against Stacy Heavner for his wrongful actions against Mr. Green. Other lawsuits have arisen out of related City Council\u2019s wrongful acts have been filed against Mayor Stan Anthony and City Manager Rick Howell. All have adopted the approach of refusing to \u201cAnswer\u201d Mr. Green\u2019s lawsuits as well as refusing to provide documents-a process called \u201cDiscovery.\u201d<\/p>\n

 <\/p>\n

Stacy Heavner has refused to get legal representation (a lawyer) and is simply refusing to even acknowledge in any way that there is a lawsuit against him. On July 14, 2020 Mr. Green\u2019s Attorney filed a \u201cMotion To Compel\u201d against Stacy Heavner. This Motion to Compel asks a Judge to \u201ccompel\u201d Stacy Heavner to follow the law and do what he is required to do. Or, face a contempt of Court sanction as well as pay Mr. Green\u2019s lawyer bills.<\/p>\n

 <\/p>\n

If Stacy Heavner refuses to show up at Court to answer this motion to compel, I expect the Sheriff\u2019s Office will be ordered to arrest Heavner and lock him up until he sees the light. At which point Stacy Heavner may realize he has been duped and abandoned and it is to his best interest to come clean and testify against those who put him up to what he did in that \u201corganized campaign.\u201d A continuing organized campaign that may land a few in prison. There is some speculation that Violet Dukes may be doing just that, coming clean and testifying against the ringleaders of the organized campaign to save her own skin from punishment that most of the City Council had a part in.<\/p>\n

Anyway folks, this latest action taken by Mr. Willie Green has just been filed at the Courthouse. A Court date will be set soon. We will let you know when the Court date is. This might be something citizens should watch for themselves instead of depending on the Shelby Daily Liar to fairly cover the news. My prediction is that I will be setting in the Courtroom for this case all alone in the visitor\u2019s gallery. And not a peep on all those who want to take the Confederate Soldier\u2019s Memorial down; somehow falsely thinking that such an act will somehow finally bring justice to a black man in Cleveland County.<\/p>\n","protected":false},"excerpt":{"rendered":"
