The new Interim Shelby City Attorney, Martha Thompson-from Gastonia, is neck deep in lawsuits against the City of Shelby\u2019s so-called leadership. And making big buck$ for herself in the process. Presently Shelby officials Rick Howell, Mayor Stan Anthony and Violet Dukes have been sued by Mr. Willie Green for their egregious actions. Mr. Green has announced that Shelby officials David Causby and David White will be sued shortly. Continued inactions and negligence by Shelby officials Charles Webber, Andrew Hopper and Eric Hendricks are believed to also being studied for the basis of lawsuits against all of them. Who says \u201cyou can\u2019t sue City Hall?\u201d Mr. Green has shown that City Hall CAN be sued and Mr. Green has already won a big victory against Rick Howell in winning a favorable ruling from Superior Court Judge W. Todd Pomeroy that Rick Howell DID engage in corruption with malicious intent against Mr. Green. Which Rick Howell and his taxpayer paid lawyer have appealed. And why not. With Rick Howell spending the City of Shelby\u2019s tax dollars, he will likely go all the way to the Supreme Court. And still lose. JMO on that and I have read every word of every document down to this very minute.<\/p>\n

Rich Howell appealed his loss from Judge Pomeroy\u2019s hearing on December 10, 2019. Time went on, billable hours for Howell\u2019s attorney. Time has gone on. Howell took his time in filing his \u201cstuff\u201d with the NC Court of Appeals. When Howell filed his Appeal, Mr. Green, through his attorney, filed his answer to Howell\u2019s appellant brief, Then Howell\u2019s attorney filed a Reply to Mr. Green\u2019s answer on May 28, 2020. Five months of billable hours at $250 per hour.<\/p>\n

Now, all the legal paperwork is in to the NC Court of Appeals and Rick Howell is now in line for his \u201cday in court.\u201d Which will likely be around 90 days from now.<\/p>\n

Previously, I have provided Rick Howell\u2019s Appeal and Mr. Green\u2019s Reply to the public. Now I am providing Rick Howell\u2019s Reply to Mr. Green\u2019s Reply for all to see. For those of us who are paying attention to all this legal \u201cmumbo-jumbo\u201d you can see the Rich Howell and his attorney appear to be grasping at straws. From Rick Howell claiming he used \u201cRhetorical Hyperbole\u201d (A joker excuse) to Howell claiming Mr. Green is using \u201ctautological\u201d (circular) arguments.) Obviously, Rick Howell\u2019s attorney has calculated that she cannot win this case in Appeals Court by \u201cdazzling the Judges with brilliance\u201d, so she has to \u201cbaffle the three-judge appeals court panel with bullshit.\u201d All the while obviously trying every trick in the book, at taxpayer expense, to avoid answering Mr. Green\u2019s complaint and then avoiding a jury trial on the merits of the case. I expect the same thing from the remainder of the City of Shelby crowd. Slow role everything in the hope that Mr. Green will just forget everything and go away. Apparently, they are too stupid to understand that that is the last thing Mr. Green will do. If they had any sense at all, they would swallow their misguided pride and settle all of this. Before Mr. Green ends up owning all their houses, cars, property and bank accounts. <\/p>\n

But stupid is as stupid does. I suspect in the end each and every one of the City of Shelby officials will have to learn the hard way.<\/p>\n

Stay tuned folks. Mr. Rick Howell has \u2018til around the end of August to learn his fate. I watched Rick Howell squirm when he was in his hearing with Judge Pomeroy. I bet there will be plenty of squirming from then all when Rick Howell\u2019s trial finally rolls around. I also bet that the rest of the Shelby leadership crowd are already squirming.
