Editor’s Note: Rev, Dr. Martin Luther King said in his famous piece, A Letter from a Jail in Birmingham that, among other things, “an Injustice anywhere is a threat to Justice everywhere.” What just happened in the Cleveland County Courthouse in the abbreviated Death Penalty Murder Trial and surprise Plea Bargain of Irving Lucien Fenner, Jr. adds many examples of Dr. King’s overall message and subject matter. A message that that has long been ignored by the White Massa’s and the Black former slaves who act as if they were still slaves after 155 years.

 Those examples being:

  • Rights delayed are rights denied.
  • Justice delayed is justice denied.
  • Discrimination is alive and well in Cleveland County.
  • Oppressors will never give freedom to the oppressed, freedom must be demanded by the oppressed (a fair trial in this particular article).
  • Evil prevails when good people do nothing–like the leaders of the black community doing nothing in this matter as well as doing nothing in the Willie Green’s Sports Complex controversy. And just about everything else in between.

Only one thing is certain in the alleged Murder of Shelby Police Department K-9 Officer Tim Brackeen in 2016 and the surprise surrender of the District Attorney’s Offices in their tearful offering of a plea bargain: The TRUTH has NOT been told!!

The truth, as told by the Shelby Star and other news media since September 17, 2016 turns out to be a pack of lies.

 District Attorney Michael Miller released a statement on the guilty plea saying, in part:

The murder of a law enforcement officer is different from other murders not because the man or woman behind the badge is any more valuable than any other man or woman. The pain and suffering of the family of a murdered law enforcement officer is no greater than the pain and suffering of the family of other murder victims. The pain and loss is so great it cannot be measured by man. Our office realizes and appreciates this fact. (Obviously a lie.)

The murder of a police officer is different because it represents an attack on every law-abiding citizen in the community. The men and women who put on the badge represent us. We, as a community, have given them the power and authority to act on our behalf in bringing dangerous and violent criminals to justice. The willingness of the women and men of law enforcement to shoulder the responsibility of protecting each of us should be backed up by a community that is willing to impose a penalty of death to one who murders one of our protectors. (And the Black community believes this???)

The State’s decision to allow Mr. Fenner to accept responsibility for the murder of Office Tim Brackeen without facing a sentence of death was made after a careful analysis of the law in the State as to the charge of murder and the facts and circumstances surrounding Mr. Fenner’s murder of Officer Brackeen. (So, where was the trial??)

District Attorney Mike Miller’s statement is also a pack of lies.

In the beginning, just like everybody else, I took the bait-hook, line and sinker-about the Shelby Police narrative that Irving Fenner was the total bad guy in the shooting death of SPD K-9 Officer Tim Brackeen. But the delays in the Capital Murder Trial the DA promised had caused five people to be stuck in jail for three years and the source report that the long delays in jail were meant to “crack” one or more of those in jail so they would testify against the others came to my attention. I immediately smelled a rat. (And, so will others by the end of this series of articles.)

Then, I pulled up all the news articles from the beginning and put them all together like a pieces of a puzzle. I soon picked up on the real problem with the DA’s case against the alleged Cop-Killer. THEY HAVE NO CASE!!!  It goes like this:

The main so-called witness, a white female named Ashley Hamrick stated that she witnessed the murder and that, although it was after midnight, she recognized Irving Fenner as the killer because of a bright street light. This account is verified by those many 2016 news accounts. But me, being me, I visited the crime scene many times during the day and during the night. There was indeed a bright streetlight exactly where Ms. Hamrick said the killing took place. But, behind a high fence that split the b ack yard, it was pitch dark.

The Brackeen body cam video that the Shelby Police Chief showed members of the black community leadership of Shelby only included voices of the struggle. It only showed voices because of one thing, the location of the struggle and the close-range shoot-out was pitch black. Certainly NOT where the witness Ashley Hamrick said it was. The DA’s Star and only witness was caught in a big lie. Likely a lie coaxed on the so-called witness, druggie Ashley Hamrick by the District Attorney’s Office so they would let her out of jail. And any ambitious DA, looking for a conviction in a high-profile murder trial that could propel the DA into the State Attorney General’s Office or even into a Law and Order Governor’s position would not waste a minute with the truth in such circumstances. Indeed, I smelled a rat indeed.

NOW that racism (that I believe to be mostly corruption) is on the front pages every day and on the news every night. All the while NO member of the Black Community Leadership has uttered one word that a black man has been denied a fair trial. Denied justice that is supposed to be there for everybody. Black and white, rich and poor.
