Commissioner Jason Falls Starts Low-Down Political Hack Job!!! Joined in by all the other Commissioners, Speaker of the House Tim Moore and Senator Warren Daniel!!! Initial Report by Robert A. Williams

There is an old saying “Fact is stranger than fiction, because fiction has to make sense.” The facts I am about to relay to you don’t make any sense, but you will find out soon enough what has happened and why I believe every bit of what I have been told about how our Commissioners, State Representative and Speaker of the House Tim Moore and State Senator Warren Daniel have abused every bit of their power, committed illegal acts and have thrown away all ethics that elected officials are supposed to display. Over pretty close to nothing that was blown up like an atomic bomb.

First, some information. The Cleveland County Commissioners, County Manager, Asst. County Manager and their spouses took a taxpayer paid trip to Washington, DC last week. I have requested through the Freedom of Information Act and NC Public Records Laws copies of the justification for those trips as well expense reports. It will be interesting to see if the taxpayers also paid for the spouses expenses. I received notification that County Policy is that it takes 7-10 business days to provide those documents. I then asked for such a policy. I have gotten into the habit of asking for all the details because if you don’t, they will not provide them.

Tim Moore is the County Attorney working directly for the Commissioners. Tim Moore is Commissioner Jason Falls First Cousin, once removed. Tim is my NC State Representative for Cleveland County and also the NC Speaker of the House, which is a powerful position statewide.

If you remember, the former County Attorney Bob Yelton was fired by the Commissioners under suspicious circumstances to make an opening in the position of County Attorney so Tim Moore could be hired. Mr. Yelton provided me with a letter he wrote to the Commissioners that I published, which brought on much controversy as Newspapers in Charlotte and Raleigh as well as major TV news picked up on the story. Scroll back for my article that included Mr. Yelton’s letter. Commissioner Eddie Holbrook stated that Tim Moore was hired as County Attorney in order for Cleveland County to have a straight connection to Raleigh for economic development purposes. I personally heard Commissioner Holbrook say that.

Senator Warren Daniel is our NC Senator representing Cleveland and Burke Counties. Senator Daniel is an attorney and lives in Morganton. Senator Daniel works with Speaker Tim Moore on every bill that the General Assembly works on and it is very likely that Senator Daniel and Speaker Moore often do each other favors.

Next, the Cleveland County Coroner is an elected office and in the 2014 Election it was highly contested with primaries and runoffs required. Robbie Morgan won the General Election and was sworn in to the four year term as Cleveland County Coroner.

The Office of Cleveland County Coroner does not generate much news but it is a very important position as the Coroner is the only County Official that can serve as Sheriff, can arrest the Sheriff, serve legal papers on the Sheriff as well as provide the first determination that a crime has possibly been committed when a dead body is found. Also note that a previous Coroner, Dwight Tesseneer, once had to take over as Sheriff for a period of time while Sheriff Raymond Hamrick was incapacitated and the department was in turmoil. And, let’s face this fact, as many problems as Cleveland County has in prosecuting crimes, including murder, the DA certainly does not need mistakes made on Death Certificates and such. Robbie Morgan has done a fine job in this office as he has the education and training for this job and is very detail oriented in all phases of this position.

Senator Warren Daniel sponsored and filed a bill in the NC Senate this past Wednesday to Abolish the Office of the Cleveland County Coroner!!! A full copy is Senate Bill-225 is attached below.

I just happened to find this out late Friday afternoon while looking for something else. When I saw the title of Senate Bill S-225 I immediately got on the phone with some of my sources. Reliable sources at that.

Why, I asked, would Cleveland County want to abolish the Office of Coroner??? I was informed in full. Now the strange part kicks in-big time!!! Folks, believe me, you can’t make this kind of stuff up. This is what I was told. And I totally believe every word.

Remember the part above about all the Commissioners, County Manager and Asst. County Manager (and maybe more) and their spouses taking this taxpayer paid trip last week to Washington, DC? Well, here is what happened after that.

Cleveland County Coroner Robbie Morgan’s wife puts a comment on Commissioner Jason Falls’ wife’s FaceBook page wondering just how much that DC trip cost the taxpayers of Cleveland County. Commissioner Jason Falls goes ballistic as he is sometimes prone to do.

Before the Commissioner Meeting on Tuesday, March 7, 2017 the Commissioners met in the conference room behind the Commissioner’s Chambers. They do this before every meeting where they get around the table and eat their catered in meal at taxpayer expense.

Commissioner Falls is still P.O.’d. about Robbie Morgan’s wife’s comment on Falls’ wife’s FaceBook page. Falls wants Robbie Morgan gotten rid of and involves the other commissioners, County Attorney Tim Moore and perhaps others. Of course all this is totally illegal. North Carolina law requires all Cleveland County’s business to be conducted in public and minutes of the meeting kept. Everybody in the room knew about this law and somebody should have stopped this kind of Cleveland County “monkey-business” from going on. All those in the room knew they were breaking the law, yet nobody stopped it and the illegal plan to get rid of Robbie Morgan was hatched. When two or more people conspire to violate the law, it is a conspiracy and Conspiracy is a serious crime in North Carolina. Read the Criminal Conspiracy Law and Legal Definition provided below.

Criminal Conspiracy Law and Legal Definition

In North Carolina a criminal conspiracy — a partnership in crime — is defined as “an agreement between two or more persons to do an unlawful act or to do a lawful act in an unlawful way or by unlawful means.” In order to be convicted of a North Carolina conspiracy offense, a defendant must be shown to have “entered into an unlawful confederation for the criminal purposes alleged.” According to the pattern jury instructions for criminal prosecutions in North Carolina, there are three essential elements of such a conspiracy offense: (1) “that the defendant and [another] entered into an agreement”; (2) “that the agreement was to commit [a crime]”; and (3) “that the defendant and [his coconspirator(s)] intended that the agreement be carried out at the time it was made.” United States v. White, 571 F.3d 365, 368 (4th Cir. N.C. 2009)

In this case the three essential elements of a conspiracy crime the Commissioners and Tim Moore are involved with are as follows:
1. They entered into an agreement to abolish the Office of Coroner of Cleveland County without due process and illegally behind closed doors.
2. The over-riding crime was to violate Public Records laws by holding this secret meeting before the Commissioner’s Meeting.
3. The conspirators intended to violate public records laws and did violate public record laws as shown by the filing of Senate Bill 225 as shown on the attached documents.

The commissioners, prodded on by Jason Falls first wanted the Office of Coroner abolished immediately. Then Commissioner Whetstine stated if this was done Coroner Robbie Morgan would have to be paid for the remainder of his term. They decided that the abolishment of the Office of Coroner would happen at the end of the term or when a vacancy might occur, whichever happened first. Cleveland County Attorney Tim Moore was then instructed by the Commissioners to abolish the office of Cleveland County Coroner as they had agreed. All this was Tuesday night March 7, 2017 before the Commissioner’s meeting.

County Attorney Tim Moore calls Senator Daniel and allegedly instructed Daniel to abolish the office of Coroner of Cleveland County. As the attached General Assembly Senate Bill 225 status shows, Senator Daniel officially files the Senate Bill on March 8, 2017 and the bill passed its first reading on March 9, 2017. Senate Bill 225 then went to committee. With the high priority that has been attached to this political hack job, the Bill could be ready to be signed by the Governor by the end of next week.

Citizens and voters of Cleveland County, what do you think about this? Has any commissioner spoken to you about abolishing the office of Cleveland County Coroner? Has the question been put to the public? A big “NO” is the answer to that.

This is an abuse of power by the Commissioners, Tim Moore and Warren Daniel. Are they doing something constructive for the public? The answer to that is also a big “NO.” Jason Falls started this but they all went along. You can be sure the DA will not prosecute because the DA never prosecutes any of the crimes committed by this crowd. Also, the Commissioners spent tons of tax dollars building the DA new offices. You can bet nothing will happen in the DA’s office about this. Not much happens in the DA’s office about a lot of other crimes either.

Straightening out the mess down at the Courthouse, the School Board and with the Commissioners has to happen at the ballot box on Election Day. Be sure to remember such stupid stuff as this and get rid of Jason Falls and the others in the 2018 and 2020 Elections. Wouldn’t it be nice if us voters “abolish” the nit-wits on the Cleveland County Commissioners and the School Board.
